USE OF THE MOTORCRUSH MOBILE APPLICATION MAY INCUR DATA CHARGES AS DICTATED BY YOUR SERVICE PROVIDER WHEN ACCESSED BY MOBILE DEVICE. BY ENTERING THE CONTEST BY USING THE MOTORCRUSH MOBILE APPLICATION YOU CONSENT TO RECEIVE AT LEAST ONE (1) AUTODIALED TEXT MESSAGE IN RESPONSE TO YOUR ENTRY, AND YOU CONSENT TO RECEIVE YOUR MOVILE DEVICE IF YOU ARE SELECTED AS A POTENTIAL PRIZE WINNER.

PROMOTION AND DATE(S)
1. These rules govern the MOTORCRUSH HOT LAPS WITH LALLY GIVEAWAY (“Promotion”), which is being conducted by ALMM Ventures, LLC (“ALMM”). The Promotion, known as MOTORCRUSH HOT LAPS WITH LALLY GIVEAWAY, will take place on Saturday, August 24, 2019 beginning at 09:00AM EST and ending at 05:00PM EST, (the “Promotion Dates”) at VIRginia International Raceway in Alton, VA.
ELIGIBILITY RESTRICTIONS
1. The Promotion is open only to legal residents of the United States (including the District of Columbia, and excluding residents of New York, Florida, Rhode Island, American Samoa, Guam, Northern Mariana Islands, Puerto Rico, the U.S. Virgin Islands, and minor outlying territories) who are 18 years of age or older at the time of entry and who are present at VIRginia International Raceway in Alton, VA on the Promotion Dates. Void everywhere else and where prohibited or restricted by law. ALMM, the members of its immediate families (spouses, parents, children and siblings, regardless of where they reside) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state, and local laws and regulations. By participating, entrants agree to comply with these Official Rules and the decisions of ALMM, which are final and binding in all respects, and entrant agrees to waive any right to claim ambiguity in the Promotion or Promotion Rules, except where prohibited by law.
2. Entrants are required to provide truthful information, and ALMM will reject and delete any entry that it discovers to be false or fraudulent. ALMM will disqualify any entry from individuals who do not meet the eligibility requirements and will also delete any entry as required by law.
3. ENTRANTS MUST BE PRESENT AT VIRginia International Raceway in Alton, VA IMMEDIATELY FOLLOWING THE PROMOTION DATES IN ORDER TO CLAIM THE PRIZE. FAILURE OR INABILITY TO BE PRESENT AT THE TIME THE PRIZE IS AWARDED IN ACCORDANCE WITH THESE RULES CONSTITUTES A FORFEITURE OF THE PRIZE.
ENTRY
1. Entrants are restricted to one (1) entry per entrant, cumulatively. There are three (3) methods of entry. Each entrant may obtain one (1) entry and one (1) entry only, by performing any or all of the following actions. No more than one (1) entry shall be given to any entrant, and performing multiple methods of entry does not entitle you or any entrant to additional entries, nor does such performance confer any benefit or increase in odds to you or any other entrant. The methods of entry are as follows:
  1. ENTRY BY CHECK-IN. During the Promotion Dates, check in your motor vehicle at VIRginia International Raceway in Alton, VA to the MotorCrush application through the application’s interface. Once you have checked in through the mobile application, you will receive one entry. Each entrant may only check in one motor vehicle, each motor vehicle may only be checked-in once, and each entrant will only receive one (1) entry regardless as to how many times they check in.
  2. ENTRY BY TEXT MESSAGE. Text “virhotlaps” to 844-947-5980 during the Promotion Dates to receive one (1) entry. Entrants utilizing this method will receive a text from ALMM confirming their entry. Message and data charges may apply depending on your mobile carrier, and ALMM hereby disclaims any responsibility or liability for costs incurred by you when entering by text message. If you enter by text message, your personal information, including your phone number, will only be utilized in connection with the Promotion, except as otherwise provided in these Official Rules, or agreed to by you.
  3. MANUAL ENTRY. Visit the MotorCrush booth at VIRginia International Raceway in Alton, VA during the Promotion Dates and complete a manual entry form, including your name, phone number, and email address to receive one (1) entry. If you enter by manual entry, your personal information, including your phone number, will only be utilized in connection with the Promotion, except as otherwise provided in these Official Rules, or agreed to by you.
2. Only one (1) prize, with a value $300.00 will be awarded at the end of the Promotion Dates as outlined in PRIZES below. The Winner will be officially notified in accordance with these Official Rules, regardless as to any unofficial announcement or notification made in person, over loudspeaker, or otherwise during or following the Promotion Dates.
3. ALMM and Carlisle are not responsible for delays or disadvantages in entering based on application functionality, mobile device connectivity, or electronic malfunction of any nature.
PRIZES
1. One (1) prize will be awarded following the Promotion Dates, with an approximate value of $300.00 described as follows:
  1. A professional driving experience at VIRginia International Raceway in Alton, VA featuring professional driver Andy Lally. Winner will be driven around a professional race course in a high performance vehicle by Andy Lally, utilizing all applicable safety gear and precautions. Please note that the prize is a strenuous activity requiring physical fitness. Because of this, Winner must execute a release of liability for ALMM and Andy Lally, as well as any relevant releases required by the track, track owner, and/or event organizer, and may be required to execute similar releases for the use of the performance vehicle and/or in order to participate in the driving experience itself.
2. Limit one (1) prize per entrant.
3. No more than the stated number of prizes specified in these official rules will be awarded. All taxes, including but not limited to, federal, state, and local taxes, and any other costs and expenses associated with the acceptance and use of a prize are solely the responsibility of the Winner. The Winners will be issued an IRS Form 1099 for the value of their respective prize if the prize value exceeds $500.00. Prizes cannot be transferred or substituted except at the sole discretion of ALMM.
WINNER SELECTION AND NOTIFICATION
1. Decisions of ALMM with respect to the Promotion are final.
2. Winner will be selected at random from a pool of all entries. Odds of winning are dependent upon the total number of entries received.
3. Winner will be notified through as many of the following as are available, based on their method of entry: (1) email to the email address provided during entry and/or the email address associated with the Winner’s MotorCrush account; (2) phone call to the phone number provided at the time of entry; (3) text message to the phone number provided at the time of entry (entrants are solely responsible and liable for any and all charges or fees associated with or assessed by mobile carriers for text messages sent and received in connection with the Promotion); (4) device notification and/or notification through the MotorCrush mobile application, if winner entered by check-in.
4. PRIZE CLAIM: Winner must claim their prize within fifteen (15) minutes of notification. Prize may be claimed by (1) responding to the message through which they were notified; (2) contacting info@motorcrush.com; or (3) visiting the MotorCrush booth at VIRginia International Raceway in Alton, VA. If Winner fails to claim the prize within the allotted timeframe, they forfeit the prize and ALMM may select up to three (3) subsequent alternates in the same manner that the Winner was selected, subject to the same prize claim requirements outlined in this paragraph.
5. Winner (or their parents or legal guardians if under the age of majority) must execute and return any required affidavit of eligibility and/or liability/publicity release following notification or prize will be forfeited. If a winner has not reached the age of majority in his/her state of residence (19 years or older if a resident of Alabama or Nebraska, 21 years or older if a resident of Mississippi and 18 years or older in other states) the prize will be awarded in the name of his/her parent or legal guardian who will be required to complete and sign any required documents. If a potential winner is deemed ineligible for any reason, cannot be contacted, fails to sign and return the required fully-executed affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize. The Promotion Entities are not responsible for any changes in an entrant or winner’s email address, phone number, mailing address or other contact information.
CONDITIONS
1. Payments of all federal, state, and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winners full Social Security Number or the equivalent for receipt of the prize. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
2. Participation in the Promotion and/or acceptance of prize constitutes entrant’s and/or winner’s permission for ALMM , their designees or agents to use in commerce, advertising, and in any media, now or hereafter known, throughout the world, in perpetuity, his/her name, prize won, hometown (city and state), voice, likeness, and or any statements made by him/her regarding the Promotion, its sponsor(s), ALMM for purposes of trade, publicity or promotion without notice or any additional financial or other compensation, notification or permission, except where prohibited by law. Each winner agrees to sign a publicity release confirming such consent prior to acceptance of the prize, except where prohibited by law. To the extent not prohibited by law, winners also agree to provide ALMM with an interview which may be used in connection with the Promotion.
3. Participation in the Promotion and/or acceptance of prize constitutes entrant’s and/or winners agreement to release, discharge, and hold harmless ALMM, Andy Lally, and their respective officers, shareholders, directors, employees, agents and representative and all of their successors and assigns (collectively the “Released Parties”) from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion, including but not limited to any claims based on publicity rights, defamation, invasion of privacy and/or prize delivery. Further, the prize winners (as well as their parent(s) or legal guardian(s), if winners are under the age of majority in their state of residence) agree to sign a liability release, agreeing to hold the Released Parties harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion.
4. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, mobile devices, identities, registrations and logins or any other methods may void that entrant’s entries and that entrant may be disqualified. Entries made by check-in of a motor vehicle which are non-unique (i.e. the vehicle has been checked-in by multiple individuals or accounts) shall be valid only for the MotorCrush mobile application profile associated with the legitimate owner and/or caretaker of such a vehicle (selected prize winners may be asked to provide proof of ownership of their vehicle, or otherwise provide authorization from such vehicle’s registered owner) and shall be void for all other entrants, and such entrants disqualified. The use of any device to automate entry is prohibited. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agent (including but not limited to promotion entry services or proxies) will void all entries by that entrant at ALMM’s discretion. ALMM’s computer system is the official timekeeping device for this Promotion. ALMM, in its sole discretion, reserves the right to disqualify any person from this Promotion if he or she tampers with the entry process or the operation of the MotorCrush mobile application or is otherwise in violation of the rules. ALMM, in its sole discretion, reserves the right to reject entries from any source, and to disqualify any person or persons who ALMM believes is tampering with the entry process in any way, including but not limited to attempts to manipulate the entry system or entry process in order to increase the odds of winning, or for any other fraudulent activity designed to affect the entry process, artificially or fraudulently augment the number of “likes” they give, or that a vehicle checked-in to their account receives, through the MotorCrush mobile application, or who is otherwise in violation of the rules or of any applicable law or regulation. To the fullest extend permitted by law, ALMM may seek prosecution of and/or damages from any person who attempts to damage any the MotorCrush mobile application or to tamper with the operation of this Promotion. ALMM further reserves the right to cancel, terminate, suspend, or modify the Promotion if it is not capable of completion as planned or if any fraud, technical failures, or any factor beyond ALMM’s control, including force majeure, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by ALMM. ALMM’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstance beyond the control of ALMM, including any force majeure event or other event of local or national importance, any segment of the Promotion is delayed, rescheduled, postponed or cancelled, ALMM reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Promotion and shall not be required to award a substitute prize.
5. Contestants understand, acknowledge, and agree that the Released Parties shall not be liable for losses, or injuries of any kind resulting from the rejection of an entry given ALMM’s belief that the contestant was abusing or tampering with the Promotion entry process in any manner or due to any technical malfunction of any entries that are late, delayed, garbled, incomplete, misdirected, lost, corrupted, or otherwise not in compliance with the rules or applicable law.
6. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering, or the administration of the Promotion or in the announcement of a price; (ii) incurred or inaccurate entry information, human error, failure, or omission; (iii) unauthorized human intervention; (iv) entries not received due to difficulty accessing the internet, service outages, delays, busy signals, poor signals, signal interference, accidental disconnection, or equipment malfunctions or any other technological problems or failures of any kind; (v) misdirected, incomplete, incorrect, or late entries; and (vi) any cancellations, delays, diversions, substitutions or omissions whatsoever by any persons or entities providing any services to winner(s) including any results thereof such as changes in services or location necessitated by same. Further, the Released Parties are not responsible for any part of a Promotion prize that cannot be awarded due to acts of God, acts of war, natural disasters, acts of terrorism, or other factors beyond the Released Parties’ control.
7. ALMM reserves the right to modify these rules for clarification or equitable purposes without materially affecting the terms and conditions of the Promotion, including without limitation, the substitution of a prize(s) of equivalent value, which will become effective upon announcement. If any provisions of these Official Rules are irrevocably inconsistent with any provision otherwise set forth or conveyed, then the provision of these Official Rules will prevail, but solely to the extent of the inconsistency.
8. Failure to comply with the Promotion rules may result in a contestant’s disqualification soles at the discretion of ALMM.
9. Except where prohibited, by entering the Promotion, each entrant agrees that:
  1. Any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize(s) awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Wilmington, DE; and
  2. Any and all claims, judgements, and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall such costs include attorneys’ fees; and
  3. No punitive, incidental, special, consequential, or other damages, including without limitation, lost profits may be awarded (collectively “Special Damages”); and
  4. Entrant hereby waives all rights to claim Special Damages and all rights to have any damages awarded multiplied or increased.
10. Delaware law governs the interpretation and construction of these Official Rules and all aspects related thereto.
11. For copies of the Official Rules or for a list of winners following completion of the Promotion (specify which), send a self-addressed, stamped envelope specifying “Official Rules” or “Winner List” to MOTORCRUSH HOT LAPS WITH LALLY Winner List or MOTORCRUSH HOT LAPS WITH LALLY Official Rules Request, ALMM Ventures, LLC, 117 N Market Street, Wilmington, DE 19801. All such requests must be received within 60 days following the completion of the Promotion.
